Family in Need of Services
FINS stands for Family in Need of Services. Families can bring a FINS petition against
a child if they meet one of three criteria: habitual absence from home without permission
(runaway), habitual absence from school, or habitual disobedience to the reasonable and
lawful commands of his or her parents. This process involves the court system to assist
parents, teachers, and others responsible for children in raising those children and
correcting behavioral problems. Others can bring FINS petitions as well.
Typically, an attorney will be appointed to represent the child, and the prosecuting
attorney will represent the parents in a FINS case if they bring it. However, that is not
always the case. Sometimes, the prosecutor may think the parents are the problem. In
those situations, the prosecutor represents the state in fulfilling its responsibility to
protect children. The parents may be ordered to do certain things and can lose custody
of their children if they do not do it. These are the situations in which parents need an
attorney.
