FAMILY LAW
The Bryant Firm has experience in all aspects of family law.  One area of family law is divorce.  Common issues
associated with divorce are property and debt division, child custody, child support, visitation, and alimony.
Alternatives to divorce in family law include separate maintenance (commonly referred to as a legal separation),
and divorce from bed and board (a partial divorce that prevents either spouse from remarriage before an absolute
divorce).

Child custody, while an issue often addressed in divorce actions, is also recurrent outside of a divorce.  Issues
commonly associated with child custody include the establishment of paternity for children born outside of
marriage, modification of previous custody, visitation and child support orders, and enforcement of previous child
support or visitation orders.

Family law is not just practiced in the domestic relations courts, but also in probate court.  Guardianships and
adoptions are heard by probate judges.  Family law is also practiced in juvenile courts through dependency
neglect, juvenile delinquency, and family in need of services cases.  Family law is complicated, so people with
family legal needs should have a family law attorney.

CRIMINAL LAW
The Bryant Firm has experience in both misdemeanor and felony criminal law.  Misdemeanors are minor
offenses that are usually heard in the District Court of a particular city (i.e. the Rogers District Court, or
Bentonville District Court).  Common issues handled by The Bryant Firm criminal law attorney include traffic
tickets, DWIs, shoplifting, no insurance, no tags, driving on a suspended license, and so forth.  Felonies are much
more serious offenses and are heard in the Circuit Court of the County (i.e. the Carroll County Circuit Court, or
Washington County Circuit Court).  Common felonies handled by The Bryant Firm criminal law attorney
include delivery of a controlled substance (drugs), assault and/or battery, theft and burglary, sexual offenses, and
so forth.  The Bryant Firm has experience in both federal and state criminal defense.

A criminal law attorney is responsible for safeguarding certain rights.  The right to remain silent and have an
attorney are not just lines out of your favorite crime show.  Criminal defendants do have the right to remain
silent and should not speak to the police without an attorney because anything that is said can be used in Court
to convict them.  Criminal defendants have the right to a fair and speedy trial by a jury of their peers.  Criminal
defendants have the right to confront their accusers, cross examine them at trial, and view evidence presented
against them.  Criminal defendants have the right to present evidence in their defense, and to be treated fairly and
impartially.  Everyone has the right to be free from warrantless and illegal searches and seizures of the person or
property. It is very important that every criminal defendant have an attorney.

Criminal law is very complicated, even in District Court on misdemeanor or traffic violations.  If you need a
criminal law attorney, call us today at (479)633-8994.

CHILD LAW
Attorney Ad Litem
In divorce and custody cases, children rarely have a say in what happens.  They are forgotten and used as a
weapon in the battle being waged by their parents.  The Bryant Firm represents children in these situations.
Joshua Bryant is certified as an ad litem attorney in the State of Arkansas in domestic relations cases.  This
means that he can represent your children if you are going through a divorce or custody battle to make sure
they have a voice and that their needs and best interests are being met.

Department of Human Services
The Bryant Firm also represents parents in some of the toughest times imaginable.  The State of Arkansas
through its Department of Human Services acts to protect children, and can sometimes do so over-zealously.
At The Bryant Firm, we work as parent counsel - an attorney for the parents when DHS takes their children
away in cases called "Dependency Neglect."

The Bryant Firm has a two fold approach to Dependency Neglect cases.  First, parents have certain
constitutional rights that must be upheld.  These rights include due process and adequate representation by
counsel.  The Department must show that it is necessary to take children away from parents and that there is
no other method of protecting a child.  Secondly, parents have the right to assistance.  The Bryant Firm
works with parents to ensure that they comply with DHS requirements, get the services from DHS that they
need, and get their children back.  A child should never remain in foster care if it can be helped.

Juvenile Delinquency
Sometimes kids get into trouble.  If your child ever does something that would be criminal for an adult, they
are often brought into juvenile court for prosecution and punishment.  For the most part, the same rules of
criminal process and adjudication apply.  They certainly need an attorney to ensure that their constitutional
rights are protected.  If your child is a juvenile delinquent, call us immediately to schedule an appointment.

Family in Need of Services (FINS)
FINS stands for Family in Need of Services.  Families can bring a FINS petition against a child if they meet
one of three criteria: habitual absence from home without permission (runaway), habitual absence from
school, or habitual disobedience to the reasonable and lawful commands of his or her parents.  This process
involves the court system to assist parents, teachers, and others responsible for children in raising those
children and correcting behavioral problems.
